1. Acceptance of Terms

By accessing or using MondayBrief ("MoBrief.com," "the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

If you do not agree to these terms, do not use the Service.

2. Account Responsibilities

When you create a MondayBrief account, you agree to:

  • Provide accurate and complete registration information
  • Keep your login credentials secure and confidential
  • Notify us immediately if you suspect unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account
  • Not share your account with unauthorized users

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use MondayBrief. The Service is designed for business use by advertising agencies and marketing professionals.

3. Service Description

MondayBrief is a software-as-a-service platform that connects to your authorized Meta (Facebook) Ad accounts, retrieves advertising performance data, generates AI-powered analysis, and delivers weekly performance briefs to you and your clients via email.

The Service includes:

  • Integration with the Meta Marketing API to read ad performance data
  • AI-generated narrative analysis of campaign performance
  • Automated weekly email delivery of performance briefs
  • A web-based dashboard for managing clients, reviewing briefs, and configuring settings
  • Team management features for agency collaboration

We do not guarantee specific outcomes, advertising results, or performance improvements. The AI-generated insights in your briefs are informational and should be reviewed by qualified professionals before acting on them.

4. Meta Account Authorization

To use MondayBrief, you must authorize access to one or more Meta Ad accounts through Meta's OAuth process. By doing so, you represent that:

  • You have the authority to grant access to the connected ad accounts
  • You have obtained any necessary permissions from account owners or clients
  • You will comply with Meta's terms of service and data use policies
  • You understand that we access your ad account data in read-only mode

You may revoke access at any time through your MondayBrief account settings or through Meta's business settings. Revoking access will stop brief generation for the disconnected accounts.

5. Payment Terms

MondayBrief offers subscription plans with monthly billing. All payments are processed securely through Stripe.

  • Free trial: New accounts receive a 14-day free trial with full access to the selected plan's features. No credit card is required to start
  • Billing cycle: Subscriptions are billed monthly on the anniversary of your subscription start date
  • Price changes: We will notify you at least 30 days before any price increase takes effect. You may cancel before the new price applies
  • Upgrades: Plan upgrades take effect immediately. You will be charged a prorated amount for the remainder of your billing cycle
  • Downgrades: Plan downgrades take effect at the end of your current billing cycle
  • Refunds: We offer a 30-day money-back guarantee from the date of your first payment. After 30 days, no refunds are provided for partial billing periods
  • Failed payments: If a payment fails, we will attempt to charge your payment method again over the following 7 days. If all attempts fail, your account may be downgraded or suspended

All prices are listed in US dollars and do not include applicable taxes. You are responsible for any taxes associated with your subscription.

6. Data and Privacy

Your use of MondayBrief is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

You retain ownership of all data you provide to MondayBrief, including client information and the content of generated briefs. We do not claim ownership of your data. We use your data solely to provide and improve the Service as described in our Privacy Policy.

You are responsible for obtaining appropriate consent from your clients before providing their email addresses or other personal information to MondayBrief for brief delivery.

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to other accounts, systems, or networks
  • Interfere with the operation of the Service or impose an unreasonable load on our infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or redistribute the Service without our written consent
  • Use automated tools (bots, scrapers) to access the Service outside of our provided API
  • Misrepresent your identity or your relationship with any ad account

We reserve the right to suspend or terminate accounts that violate these terms.

8. Intellectual Property

MondayBrief, its logo, design, features, and documentation are the intellectual property of MondayBrief and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

The AI-generated brief content is created for your use. You are free to share, forward, or archive briefs as needed for your business purposes.

9. Service Availability

We strive to maintain high availability, but we do not guarantee uninterrupted access to the Service. Downtime may occur due to scheduled maintenance, infrastructure issues, or circumstances beyond our control. We will make reasonable efforts to notify you in advance of planned maintenance.

The Service depends on third-party APIs (Meta, Anthropic, SendGrid, Stripe). Changes or outages in these services may affect MondayBrief's functionality. We are not responsible for disruptions caused by third-party service providers.

10. Limitation of Liability

To the maximum extent permitted by applicable law, MondayBrief and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to:

  • Loss of revenue, profits, or business opportunities
  • Decisions made based on AI-generated insights
  • Inaccuracies in ad performance data or AI analysis
  • Service interruptions or data loss
  • Unauthorized access to your account resulting from your failure to safeguard credentials

Our total liability for any claim arising from these terms or the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that AI-generated brief content will be error-free, complete, or suitable for any particular purpose. You acknowledge that AI-generated insights are based on available data and algorithms, and should be reviewed and validated by qualified professionals.

12. Termination

Either party may terminate this agreement at any time:

  • By you: You may cancel your subscription and close your account at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period
  • By us: We may suspend or terminate your account if you violate these terms, fail to pay, or if we reasonably believe your use poses a risk to the Service or other users. We will provide notice where practicable

Upon termination, your right to use the Service ends immediately. We will retain your data for 30 days after account closure to allow for reactivation, after which it will be permanently deleted in accordance with our Privacy Policy.

13. Indemnification

You agree to indemnify and hold harmless MondayBrief and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these terms, or your infringement of any third-party rights.

14. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these terms or the Service shall be resolved in the state or federal courts located in Delaware.

15. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes, we will notify you by email or by placing a prominent notice on our website at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated terms.

If you do not agree to the updated terms, you may cancel your subscription before the changes take effect.

16. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.
